The agreement

These Terms of Service ("Terms") are an agreement between you and Brandnamix (Pty) Ltd, the operator of Jinxx ("Jinxx", "we", "us" or "our"). They govern your use of the Jinxx platform, Marketing.sucks, related applications, and any services that refer to these Terms.

By creating an account, accepting an order, or using Jinxx, you agree to these Terms. If you use Jinxx for a business or another organisation, you confirm that you have authority to bind it. If an order form, data processing agreement, or product-specific term conflicts with these Terms, the more specific document applies to that conflict.

Accounts and authority

You must be legally able to enter into this agreement and provide accurate account information. You are responsible for keeping login details, authentication methods, and connected-account permissions secure, and for activity carried out through your account. You confirm you are legally allowed to have the required permission to access the accounts and publish content to same.

• Use individual credentials. Do not share a login where named-user access is required.
• Tell us promptly if you suspect unauthorised access or a compromised connection.
• Only add brands, team members, websites, data, and platform accounts you are authorised to manage.
• Keep account and billing information current.

What Jinxx does

Jinxx is an AI-assisted marketing operations platform. It can help users capture brand context, develop ideas and campaigns, create and format content, organise review and approval, and work with supported publishing or design platforms. Features depend on the plan, connected services, geography, account permissions, and the availability of third-party APIs.

Jinxx supports marketing work; it does not replace human judgement. You remain responsible for strategy, factual accuracy, legal compliance, permissions, final approval, and anything you publish or instruct Jinxx to publish.

AI-assisted work

AI-generated or AI-assisted output can be incomplete, inaccurate, similar to output produced for someone else, or unsuitable for a particular audience or channel. You must review output before use, especially claims, prices, comparisons, regulated statements, personal information, intellectual property, and platform-specific disclosures.

To the extent permitted by law and subject to third-party rights, you may use output generated for you. Jinxx does not promise that output is unique, registrable, non-infringing, or fit for a particular legal, financial, medical, employment, political, or regulated purpose.

Your brands, content and instructions

You retain ownership of content, brand assets, data, instructions, and other material you submit or connect ("Customer Content"). You grant us a limited, worldwide licence to host, copy, format, analyse, transmit, and otherwise process Customer Content only as needed to provide, secure, support, and improve the service, comply with law, and follow your instructions.

You confirm that you have the rights and permissions needed for Customer Content and for any website or account you ask Jinxx to scan, analyse, use, or publish to. Do not use Jinxx to bypass access controls or collect information you are not entitled to access.

Connected services

Jinxx may connect to services such as LinkedIn, Meta products, Canva, WordPress, and other platforms (each a "Connected Service"). A connection is optional. When you connect one, you authorise Jinxx to access and act on the data and permissions shown during the connection process, for the purposes you select.

• The Connected Service's own terms, policies, content rules, and technical limits also apply to your use of that service.
• You must have authority over the profile, page, business, workspace, site, design, media, or destination you connect.
• Jinxx uses official or approved access methods where required. You may not use Jinxx for scraping, credential sharing, or unauthorised automation.
• We request only permissions reasonably needed for the selected feature. You can revoke a connection, although doing so may stop related features.
• A platform may change, restrict, suspend, or end its API or your access. We are not responsible for a Connected Service's availability or decisions.
• Our integration does not mean that LinkedIn, Meta, Canva, Automattic, WordPress, or another platform sponsors or endorses Jinxx.

Where a platform requires approval for a use case, Jinxx will only provide that use through the approved access and scope. We may limit or disable a connection to comply with platform rules, security requirements, or law.

Approval, scheduling and publishing

Jinxx may prepare, queue, schedule, or publish content when you choose those actions and have an eligible destination connected. You control approvals, destinations, timing, and permissions. Review queues and approval settings support your process; they do not transfer accountability for the content to Jinxx.

You are responsible for checking the final destination, audience, date, time zone, media, links, disclosures, and copy. Platform delays, expired permissions, rate limits, moderation decisions, or third-party outages may prevent or delay publication.

Acceptable use

Do not use Jinxx, or help anyone else use it, to:

• break the law, platform rules, sanctions, export controls, or another person's rights;
• send spam, run deceptive campaigns, impersonate others, manipulate engagement, or make misleading claims;
• upload malware, probe security, interfere with the service, evade limits, or reverse engineer protected parts of the platform;
• scrape, harvest, enrich, or combine personal or platform data without a lawful basis and the required permission;
• publish unlawful, hateful, abusive, discriminatory, sexually exploitative, or dangerous content;
• use another person's confidential information, personal information, image, voice, trade mark, copyright work, or account without permission;
• train competing models or services on Jinxx, resell access, or copy the platform except where we agree in writing.

We may investigate suspected misuse and remove content, restrict a feature, suspend access, or cooperate with a lawful request where reasonably necessary.

Plans, payments and Carrots

Prices, included usage, renewal terms, taxes, and any plan limits are shown before purchase or in the relevant order. You authorise the stated payment method and processor to collect amounts when due. Statutory cooling-off, refund, and consumer rights continue to apply where they cannot lawfully be excluded.

Jinxx may measure AI or platform usage in credits called Carrots. Carrots are a service-usage unit, not money, property, cryptocurrency, or stored value. They cannot be transferred or redeemed for cash. Any expiry, rollover, included allowance, or purchase rule will be shown in the plan or purchase terms before it applies.

Jinxx technology and feedback

We and our licensors own Jinxx, its software, workflows, interfaces, documentation, designs, trade marks, and service data that does not identify you or reveal Customer Content. These Terms do not transfer those rights to you.

If you give us feedback, you allow us to use it without restriction or payment, provided we do not publicly identify you as the source without permission.

Privacy and security

Our Privacy Policy explains how we handle personal information. Our Data Deletion page explains how to disconnect platforms and request deletion. We use reasonable technical and organisational safeguards, but no internet service can guarantee absolute security.

If you process personal information through Jinxx for your own purposes, you are responsible for your notices, lawful basis, consent, data-subject requests, retention decisions, and other controller obligations. A data processing agreement may apply where Jinxx processes personal information on your behalf.

Confidential information

Each party may receive non-public information that a reasonable person would understand to be confidential. The receiving party will use it only for this agreement, protect it with reasonable care, and disclose it only to people who need it and are bound to protect it. This does not cover information that is public without breach, independently developed, lawfully received from another source, or required to be disclosed by law.

Changes, availability and third parties

We may improve, replace, or discontinue features and may perform maintenance. We will take reasonable care to avoid material disruption and give notice of a material adverse change where practical. Jinxx may rely on hosting, AI, payment, analytics, security, and Connected Service providers. Their outages or policy changes can affect the service.

We may update these Terms. Material changes will be notified through the service, by email, or on this page. The new date will appear above. If a change materially reduces your rights, it applies prospectively unless law requires otherwise.

Suspension and termination

You may stop using Jinxx and close your account, subject to amounts already due and any agreed plan terms. We may suspend or terminate access for material breach, non-payment, security risk, unlawful activity, platform-policy requirements, or harm to Jinxx, users, or third parties. Where reasonable, we will give notice and an opportunity to fix the issue.

On termination, your right to use the service ends. Provisions that by their nature should continue will survive, including ownership, confidentiality, payment obligations, disclaimers, liability limits, indemnities, and dispute terms. Data handling after closure follows the Privacy Policy and Data Deletion page.

Disclaimers

Jinxx is provided with reasonable care and skill. Except for rights or warranties that cannot legally be excluded, the service is provided as available. We do not guarantee uninterrupted operation, a particular marketing result, search ranking, answer-engine citation, engagement level, lead volume, revenue outcome, platform approval, or that AI output will be error-free.

Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, or gross negligence where applicable. Subject to that, neither party is liable for indirect, incidental, special, punitive, or consequential loss, or for lost profits, revenue, goodwill, data, or business interruption, arising from the service.

To the extent permitted by law, Brandnamix's total aggregate liability arising from Jinxx in any twelve-month period is limited to the amount you paid for Jinxx during that period. If you used only a free service, the cap is ZAR 1,000. These limits apply regardless of the legal theory and do not reduce rights you have under the Consumer Protection Act or other law that cannot be waived.

Your responsibility for claims

To the extent permitted by law, you will defend and indemnify Brandnamix and its personnel against third-party claims, losses, and reasonable costs arising from your Customer Content, your instructions or publishing decisions, your breach of these Terms, your unlawful use of personal or platform data, or your infringement of another person's rights. This does not apply to the extent the claim was caused by Brandnamix's breach, negligence, or wilful misconduct.

Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. The parties will first try in good faith to resolve a dispute through written notice and direct discussion. If it is not resolved, the courts of South Africa have jurisdiction, subject to any consumer right to bring a matter in another competent forum.

General terms

You may not assign this agreement without our written consent, except as part of a lawful business reorganisation or sale with notice to us. We may assign it as part of a reorganisation, financing, or sale of the relevant business, provided your rights are not materially reduced. If one provision is unenforceable, the rest remains in force. A delay in enforcing a right is not a waiver. These Terms and the documents they incorporate are the entire agreement about the service.
